Terms of Service

1. Agreement to Terms

By accessing, registering for, or using StatMyLife (the "Service"), you enter into a legally binding agreement with StatMyLife ("we", "us", "our") and agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree to these terms in their entirety, you are prohibited from using the Service and must cease use immediately.

Your continued use of the Service after any modifications to these terms constitutes acceptance of those modifications. We reserve the right to update these terms at any time, and material changes will be communicated via email to your registered address at least 30 days prior to taking effect.

2. Service Description and Scope

StatMyLife provides a personal analytics platform enabling users to track daily activities, log time allocation, visualize data, and export personal information. The Service includes but is not limited to: activity logging interfaces, data visualization tools, personal analytics dashboards, and data export functionality in machine-readable formats.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, except that discontinuation of the Service entirely will require 90 days' written notice to allow you to export your data.

3. Eligibility and Account Registration

To use the Service, you must be at least 16 years of age (or the age of majority in your jurisdiction, whichever is higher). The Service is available to users worldwide. By registering, you represent and warrant that all information provided is accurate, current, and complete. You agree to maintain and promptly update your account information to ensure its accuracy.

You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You agree to immediately notify us at markusfhc@statmylife.com of any unauthorized use of your account or any other breach of security. You acknowledge that you are responsible for all activities that occur under your account, whether or not authorized by you.

We reserve the right to refuse service, terminate accounts, or remove or edit content in our sole discretion without notice or liability.

4. Right of Withdrawal

In accordance with consumer protection legislation (including Norwegian and EU/EEA laws where applicable), you have a right to withdraw from this agreement within 14 days of registration without providing any reason. To exercise your right of withdrawal, you must inform us of your decision by sending a clear statement to markusfhc@statmylife.com.

Upon valid withdrawal, we will delete your account and all associated personal data within 30 days. While the Service is currently provided free of charge, this right applies regardless of payment status and extends to account deletion requests. Users outside the EU/EEA may have similar or additional rights under their local consumer protection laws.

5. Fees, Payment Terms, and Future Pricing

The Service is currently provided free of charge to all users worldwide. Should we introduce paid features, premium tiers, or subscription models in the future, the following terms will apply:

All prices will be clearly displayed in Norwegian Kroner (NOK) inclusive of applicable value-added tax (VAT) where required by law. For users outside Norway, prices may also be displayed in your local currency for convenience, with the NOK amount being authoritative in case of discrepancies. Existing users will receive a minimum of 30 days' written notice before any charges are implemented. You will have the opportunity to accept or decline paid features, and declining will not affect your access to features that were previously free.

Payment terms will comply with Norwegian e-commerce regulations and applicable international consumer protection laws. All transactions will be processed securely, and you will receive confirmation of any charges via email.

6. Data Ownership, Rights, and Portability

You retain complete ownership of all data you input into the Service, including but not limited to activity logs, time entries, preferences, and any other personal information. We claim no intellectual property rights over your content.

We provide full data portability in compliance with GDPR Article 20. You may request and receive your data in a structured, commonly used, and machine-readable format (JSON) at any time. Upon account deletion, all personal data will be permanently and irreversibly deleted from our systems within 30 days, except where retention is required by law.

We will never sell, rent, lease, or otherwise transfer your personal data to third parties for their marketing purposes. Your data is used solely to provide and improve the Service as detailed in our Privacy Policy.

7. Privacy, Data Protection, and GDPR Compliance

We are fully compliant with the General Data Protection Regulation (GDPR), Norwegian data protection laws, and respect international data protection standards. Our processing of your personal data is governed by our Privacy Policy, which forms an integral part of these terms.

All users, regardless of location, have the following rights: the right to access your personal data, the right to rectification of inaccurate data, the right to erasure ("right to be forgotten"), the right to restriction of processing, the right to data portability, and the right to object to processing. Users in certain jurisdictions may have additional rights under local law. To exercise any of these rights, contact markusfhc@statmylife.com.

We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including encryption, access controls, and regular security assessments.

8. Prohibited Conduct and Acceptable Use

You agree not to engage in any of the following prohibited activities:

(a) Attempting to gain unauthorized access to the Service, other user accounts, or computer systems or networks connected to the Service through hacking, password mining, or any other means;

(b) Reverse engineering, decompiling, disassembling, or otherwise attempting to discover the source code or underlying algorithms of the Service;

(c) Uploading, posting, or transmitting any content that contains viruses, malware, or other malicious code;

(d) Violating any applicable local, national, or international law, including but not limited to Norwegian data protection regulations and criminal law;

(e) Harassing, threatening, or defaming other users, our staff, or third parties;

(f) Using automated scripts, bots, or other automated means to access the Service in a manner that sends more request messages to our servers than a human could reasonably produce in the same period;

(g) Interfering with or disrupting the Service or servers or networks connected to the Service;

(h) Impersonating any person or entity or falsely stating or misrepresenting your affiliation with a person or entity;

(i) Collecting or storing personal data about other users without their express consent.

Violation of this section may result in immediate termination of your account and may subject you to civil and criminal liability.

9. Intellectual Property Rights

The Service, including all software, code, designs, text, graphics, logos, icons, images, audio clips, and other content, as well as the selection and arrangement thereof, is the exclusive property of StatMyLife and is protected by Norwegian and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for personal, non-commercial purposes. This license does not include any right to: (a) resell or make commercial use of the Service or its contents; (b) distribute, publicly perform, or publicly display any content from the Service; (c) modify or make derivative works based on the Service; (d) use any data mining, robots, or similar data gathering or extraction methods; or (e) download any portion of the Service except as expressly permitted.

"StatMyLife" and associated logos are trademarks of StatMyLife. You may not use these trademarks without our prior written consent.

Your personal data and user-generated content remain your property and are not subject to our intellectual property claims, as specified in Section 6.

10. Service Availability, Modifications, and Interruptions

While we strive to maintain high availability, we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

We may perform scheduled maintenance with advance notice when reasonably possible. We may also perform emergency maintenance without notice when necessary for security or operational reasons.

We reserve the right to modify features, functionality, or the terms governing the Service. Material changes to these terms will be communicated to you at least 30 days before they take effect. Your continued use of the Service after such changes constitutes acceptance.

In the event of permanent discontinuation of the Service, we will provide 90 days' written notice and ensure you have the opportunity to export all your data.

11. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will meet your specific requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) any errors in the Service will be corrected; or (d) the Service is free of viruses or other harmful components.

This disclaimer does not affect any warranties or consumer rights that cannot be excluded or limited under Norwegian law.

12. Limitation of Liability

Under Norwegian law, our liability is determined as follows:

We are fully liable for: (a) damages caused by our intentional misconduct or gross negligence; (b) damages resulting from breaches of data protection regulations; (c) personal injury or death caused by our negligence; and (d) any other liability that cannot be excluded or limited under Norwegian law.

To the maximum extent permitted by Norwegian law, we are not liable for: (a) indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses; (b) damages resulting from third-party services, including hosting providers, email services, or internet service providers; (c) damages resulting from unauthorized access to or alteration of your transmissions or data; (d) damages resulting from your failure to maintain the confidentiality of your account credentials; or (e) any other matter beyond our reasonable control.

Where we are liable for damages under Norwegian law, our aggregate liability shall not exceed the amount you have paid to us in the 12 months preceding the claim, or NOK 1,000 if the Service was provided free of charge.

13. Indemnification

You agree to indemnify, defend, and hold harmless StatMyLife, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party, including other users; or (d) your violation of any applicable laws or regulations.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.

14. Dispute Resolution and Governing Law

These Terms are governed by and construed in accordance with the laws of Norway, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

For users located in Norway: Any dispute arising out of or relating to these Terms or the Service shall be resolved in the courts of Oslo, Norway.

For users located outside Norway: Disputes may be resolved in the courts of Oslo, Norway, or in the courts of your local jurisdiction where applicable law permits. We will make reasonable efforts to resolve disputes informally before resorting to formal legal proceedings.

EU/EEA consumers retain the right to file complaints with their local consumer protection authorities or use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Norwegian consumers may file complaints with the Norwegian Consumer Council (Forbrukerrådet) at forbrukerradet.no.

Before initiating any formal legal proceedings, you agree to first contact us at markusfhc@statmylife.com to attempt to resolve the dispute informally.

15. Account Termination and Suspension

Termination by You: You may terminate your account at any time by using the account deletion feature in your profile settings or by contacting markusfhc@statmylife.com. Upon termination, your data will be deleted in accordance with Section 6.

Termination by Us: We reserve the right to suspend or terminate your account immediately, with or without notice, for any of the following reasons: (a) violation of these Terms; (b) illegal activity or violation of applicable laws; (c) fraudulent, harassing, or abusive behavior; (d) prolonged inactivity; (e) requests by law enforcement or government agencies; or (f) unexpected technical issues or security concerns.

Where reasonably possible, we will provide 14 days' written notice before termination and allow you to export your data, except in cases where immediate termination is required for legal, security, or safety reasons.

Termination of your account does not relieve you of any obligations incurred prior to termination, nor does it affect any rights or remedies we may have under these Terms or applicable law.

16. Third-Party Services and Links

The Service may contain links to third-party websites or services that are not owned or controlled by StatMyLife. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.

We use the following third-party services: (a) Brevo for transactional email delivery; and (b) Hostinger for database hosting. These services have their own terms and privacy policies, which we encourage you to review.

17. Assignment and Transfer

You may not assign, transfer, or sublicense these Terms or any of your rights or obligations hereunder without our prior written consent. Any attempted assignment in violation of this section shall be null and void.

We may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law. We will notify you of any such assignment that materially affects your rights under these Terms.

18. Severability and Waiver

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. No waiver of any breach of these Terms shall constitute a waiver of any subsequent breach.

19. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and StatMyLife concerning the Service and supersede all prior agreements, understandings, negotiations, and discussions, whether oral or written, between the parties.

No amendment to these Terms shall be effective unless made in writing and signed by an authorized representative of StatMyLife or published on the Service with notice to users.

20. Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms where such failure results from circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, fuel, energy, labor, or materials.
